2. Products and Availability
Nature of Live Plants: Plants are living entities. The actual plant delivered may vary slightly in size, shape, and color from the images displayed on our website or catalog. Minor leaf drops or stress during transit are normal and usually recover with proper care.
Availability: All orders are subject to stock availability. If a specific plant is out of stock after an order is placed, we will notify you to arrange a suitable replacement, delay the shipment until it is available, or process a refund for that item.
3. Pricing and Payments
Pricing: All prices listed are in Indian Rupees (INR). We reserve the right to change prices at any time without prior notice. Wholesale pricing is subject to minimum order quantities as agreed upon during the quoting process.
Taxes: Applicable taxes (such as GST) will be added to your final invoice unless otherwise stated.
Payment Terms: For retail orders, full payment is required before dispatch. For wholesale and commercial landscaping orders, payment terms (including advances) will be clearly outlined in your custom quotation.
4. Shipping and Delivery
Dispatch and Transit: We take utmost care in packing live plants for safe transit across India. However, Kadiyam Evergreen Nursery is not liable for delays caused by third-party logistics, weather conditions, or unforeseen transport strikes.
Risk of Loss: The risk of loss or damage passes to the buyer once the goods are handed over to the transport or courier partner.
5. Returns, Refunds, and Replacements
Live Plant Policy: Due to the perishable nature of live plants, we generally do not accept returns.
Transit Damage: If you receive dead or severely damaged plants, you must notify us within 24 hours of delivery with clear photographs of the unboxing process and the damaged plants.
Resolution: Upon verification, we will, at our sole discretion, offer a replacement in your next order or issue a partial/full refund for the damaged items. We do not guarantee the survival of plants once they have been potted or planted in your soil, as this depends entirely on post-delivery care, climate, and local soil conditions.
6. Landscaping and Services
For clients engaging our landscape design, garden setup, or irrigation services, a separate service agreement and warranty policy (if applicable) will be provided alongside the project quotation.
7. Website Usage and Intellectual Property
All content on this website, including text, logos, images, and graphics, is the property of Kadiyam Evergreen Nursery and is protected by copyright laws. You may not reproduce, distribute, or use our content for commercial purposes without written permission.
8. Limitation of Liability
To the maximum extent permitted by law, Kadiyam Evergreen Nursery shall not be liable for any indirect, incidental, or consequential damages arising from the use of our website, our plants, or our services.
9. Governing Law and Jurisdiction
These Terms & Conditions shall be governed by and construed in accordance with the laws of India. Any disputes arising out of these terms or your purchases shall be subject to the exclusive jurisdiction of the courts in Rajahmundry, East Godavari District, Andhra Pradesh.
